Terms of Service
Last updated: 30 September 2026
These terms apply when you create a MOAI account or subscribe to MOAI. Please read them before you subscribe. They don't affect your legal rights as a consumer.
1. Who we are
MOAI is provided by Jack Smith trading as Successfit, St Sampsons, Guernsey, GY2 4RQ ("Successfit", "we", "us"). You can contact us at jack@successfit.net.
2. What MOAI is
MOAI is a habit, fitness and wellbeing app. It includes a personalised daily plan, workouts and training programmes, diet guidance and meal logging, mindfulness and breathing sessions, journalling, challenges and progress tracking.
3. Health and safety
MOAI is general wellbeing guidance, not medical advice. It doesn't diagnose or treat any condition and it isn't a substitute for a doctor, dietitian or other qualified professional.
- Talk to a doctor before starting a new exercise, diet, fasting or cold-exposure routine, especially if you're pregnant, have a medical condition or take medication.
- Stop any activity that causes pain, dizziness or shortness of breath, and get medical help if needed.
- You take part in any activity at your own risk and within your own limits.
4. Your account
- You must be at least 18 years old to use MOAI.
- Give accurate details and keep your password private. You're responsible for activity on your account.
- One account is for one person.
5. Subscription and payment
- MOAI costs £19.00 per month, including VAT where it applies. You pay the first month when you subscribe, then every month on the same date until you cancel.
- Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles payment, billing, receipts and payment-related customer service and returns. Your purchase is also covered by Paddle's buyer terms.
- If a payment fails, Paddle may retry it. If it still can't be collected, your access to paid features ends.
- If we change the price, we'll tell you at least 30 days before it applies to you. You can cancel before then if you don't want to continue.
6. Cancelling
You can cancel at any time in the app: Profile → Manage Subscription. When you cancel, you won't be charged again, and you keep access until the end of the month you've already paid for.
7. Refunds
See our Refund Policy.
8. Using MOAI fairly
Don't misuse MOAI. That includes trying to get around the paywall, accessing other people's accounts, copying or reselling MOAI's content, or interfering with how the app works. We may suspend or close accounts that do.
9. Our content and yours
MOAI's workouts, programmes, text, characters and design belong to us or our licensors. Your subscription lets you use them for your own personal use.
What you enter (such as habits, journal entries and meal logs) stays yours. We only use it to run MOAI for you, as set out in our Privacy Policy.
10. Changes and availability
We keep improving MOAI and may change or remove features. We aim to keep it available but can't promise it will never be interrupted. If we make a change that significantly reduces what you've paid for, you can cancel and we'll refund any unused part of your current month.
11. Our responsibility to you
We aren't responsible for losses that weren't foreseeable, for business losses, or for injury resulting from activities you choose to do (see section 3). Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law doesn't allow us to limit, and nothing affects your statutory rights as a consumer.
12. Closing your account
You can ask us to delete your account at any time by emailing jack@successfit.net. Cancel your subscription first so you aren't charged again.
13. Changes to these terms
If we update these terms, we'll change the date at the top and, for important changes, tell you in the app or by email before they apply.
14. Law
These terms are governed by the law of Guernsey. If you're a consumer living outside Guernsey, you also keep any protection the law where you live gives you, and you can bring a claim in your local courts.
